양도소득세 자경농지의 도시지역 편입 이후 공공용지로 수용된 경우 양도세 감면 중복적용 여부

Q. 보유하던 자경농지가 도시지역으로 2021년 1월에 편입이 되었고, 이후에 공공용지로 수용이 되어 양도소득세를 신고하려고 합니다. 이 경우 취득일로부터 도시지역 편입일까지는 8년 자경농지로 양도소득세 감면을 계산하고, 도시지역 편입일 이후로는 공공용지로 감면을 적용할 수 있는지 궁금합니다.

A. 거주자가 토지 등을 양도하여 2 이상의 양도소득세의 감면규정을 동시에 적용받는 경우에는 당해 거주자가 선택하는 하나의 감면규정만을 적용하는 것으로 판단됩니다. 아래 해석사례를 참고하시기 바랍니다.

「조세특례제한법」 제127조의 규정을 적용할 때 공업지역 등 편입일 이후 8년 자경감면 배제분에 대해서는 같은 법 제77조에 따른 공익사업용 토지 등에 대한 양도소득세의 감면을 적용하지 아니하는 것임(같은 뜻 : 부동산거래관리과-1168, 2010.09.17.).
